A BILL to amend article three, chapter twenty-four of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
one-c, relating to requiring verification of approved septic
or sewage disposal system before connection of public
utilities to residential or commercial structures utilizing
individual, on-site systems.
Be it enacted by the Legislature of West Virginia:
That article three, chapter twenty-four of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section one-
c, to read as follows:
ARTICLE 3. DUTIES AND PRIVILEGES OF PUBLIC UTILITIES SUBJECT TO
REGULATIONS OF COMMISSION.
§24-3-1c. Ver
ification of approved septic or sewage disposal
system required before connection of public
utilities to residential or commercial structures
utilizing individual, on-site systems.
No public utility, as defined in section two, article one of
this chapter, may install or establish utility service to a
residential or commercial structures utilizing individual,
on-site systems, unless the owner thereof provides written
verification beforehand to the public utility that the commercial
establishment or residential home is presently serviced by a
system or method of sewage or excreta disposal that has been
approved in writing by the commissioner of health or his or her
authorized representative, as required by section nine, article
one, chapter sixteen of this code, or the owner thereof provides
written verification to the public utility that the commissioner
of health or his or her authorized representative has approved
the owner's plans for installation of a system or method of
sewage or excreta disposal which meets all applicable
requirements.
NOTE: The purpose of this bill is to require residential
or commercial structures utilizing individual, on-site systems
to provide verification of an approved septic or sewage disposal
system before public utilities may be connected.
